T.E.M.S. 990

It took quite a bit of time but we did finally locate the 990 for Thurman EMS for 2011. Please note that on the final page of this document is a list of the Board Members for TEMS, clearly this would cause a conflict of interest for soon to be Town Board Members, Eddy and Smith.

We will continue to search for their 990 for 2012.

Summary of New York's Relief from Civil Disabilities statute

Please pay note to first line under "Restrictions on Issuance" located at the bottom of the page.

A question was asked. If Mr. Haskell won the election and can not serve, what would happen? We have spoken with board members about the rules and they are; If a supervisor is removed from the seat the board appoints the new supervisor. This happened when Mr. Haskell was replaced by Mr. Pitkin. If the board appoints a board member for supervisor a board member seat will be open and the board with new supervisor will appoint a new board member. What that would mean in real terms is that the composition of the town government would be chosen by three to five people.

Tax Cap Review under the Wood Administration

Below please find the Report for the Tax Cap Review.
Once again we like to inform the reader so that they may make educated decisions.

December 28, 2012

Ms. Evelyn Wood, Town Supervisor
Town of Thurman
PO Box 29
Athol, NY 12810

Report No: 2012M-904-TC

Dear Town Supervisor Wood:

Chapter  97  of  the Laws of 2011 established a tax levy limit on all local
governments  in  New  York  State,  effective  January  1,  2012.  This law
requires  that local governments maintain any property tax levy increase to
no  more  than  2 percent or the rate of inflation, whichever is less.  The
law  does  provide  exemptions  for  certain  specific costs and allows the
governing  board  to  override the tax levy limitation with a supermajority
vote.

We  have  determined  that your tax levy for 2013 was materially within the
allowable limit.

If  you  have any questions, please contact our Glens Falls Regional Office
at (518) 793-0057.

                                          Sincerely,

                            Steven J. Hancox

                            Deputy Comptroller
                            Division of Local
Government

RE: Relief from civil disabilities

We apologize for any difficulty reading this.
This document could be an answer to a question about the former Supervisor's ability to vote or serve office.
Note the words in box 11. a.
Quote "Excluding the right to retain or be eligible for public office by virtue of the fact that the certificate is issued at the time of sentence."
It's interpretation is currently being discussed in legal circles. No concrete decision has been made to our knowledge.
