Town Business

Majority of board acts as body. The town board as a group, is the executive head of the town and must function as a body. There is no true executive in town government like the mayor of a city or village. Thus, an individual board member or town supervisor may not unilaterally act on behalf of the town board and each board member has the same authority as any other board member.
(citation, Town Law Manual, Association of Towns of the State of New York, 2016 edition, page 19, Subsection 2-16, B,1)

Mr. Eddy did not want to make a decision to litigate against Rainmaker, the whitespace developer without Legal Counsel present to explain and answer questions regarding the situation.

The supervisor refused to entertain or table discussion until counsel could be present.

Gail Seaman, Susan Shepler and Evelyn Wood voted in favor of litigation, without counsel present.

The suit failed, costing our town thousands of dollars in legal fees.
